Tastequest is a trading name of JV Foods Ltd.

1.   To comply with the Food Safety Act and its guarantees of temperature control, frozen and chilled foods can only be returned at the time of delivery.

2.   All shortages or damaged product are to be notified in writing within 24 hours of receipt. All damaged goods must be returned to or made available for inspection by Tastequest. No claims in respect of shortages or damaged product can otherwise be considered.

3.   No liability will be accepted for any delays in delivery. Verbal or written commitments in respect of proposed delivery dates or times are indicative only and not legally binding.

4.   Tastequest reserve the right to amend product specifications and prices at any time and without prior notice.

5.   No claims for contingent or consequential losses (excepting public liability and death) will be accepted as a result of using Tastequest or any of products supplied by Tastequest. No financial offset can be accepted for any claims under any circumstances whatever unless supported by a duly issued Tastequest' credit note.

6.   Minimum delivery is 1 pallet per temperature type.

7.   Payment terms, where a credit facility has been granted, are end of month plus 10 days, unless special terms have been agreed in writing. Delivery of goods without payment, or delivery of goods whilst an account is over terms does not constitute an implicit revision to the prevailing credit      terms under any circumstances.

8.   Tastequest reserve the right to withdraw credit facilities at any time and without prior notice.

9.   All goods are offered subject unsold.

10. Title to all goods supplied by Tastequest remains the property of Tastequest until
(i)  The goods are paid for in full.
(ii) All invoices for any goods supplied by Tastequest have been paid by cleared funds without offset.

11. It is a condition of dealing with Tastequest that the contract for any goods sold takes place at      Tastequest' place of Business. It is also a condition of sale that in the event of non-payment for any reason whatsoever, all customers will allow Tastequest or their authorised agent(s) access to any      premises where Tastequest' goods are located. This is without prejudice to any accrued right of the Seller there under or otherwise.

12. Unpaid cheques will be charged at £ 30 per item. Tastequest reserves the right to charge interest on  overdue accounts at a rate of 6% over the prevailing base rate at HSBC.

13. Any costs incurred by J.V. Foods Ltd for the collection of outstanding debts will be added to the amount due.

14. Tastequest shall not be bound by any variation, waiver of, or addition to these conditions unless such variation, waiver or addition is agreed in writing. Waiver by Tastequest of any default (whether in respect of the instant contract or an earlier contract subject to these conditions) shall be deemed not to be a waiver of any default which may occur thereafter.
